Durable Power of Attorney

When you grant someone authority under a power of attorney, that authority is in effect until you revoke it or the power of attorney becomes ineffective. One way the power of attorney loses effectiveness is if you, the grantor, suffer a condition that prevents you from acting. Because the power of attorney is your legal "clone", if a condition such as a medical event, occurs that prevents you from acting, then your "clone" is prevented from acting.

To prevent this situation, a power of attorney can be designated as durable, which means it survives any event that happens to you and allows your wishes to be carried regardless of your situation.
